Police say a Dutchess County man who was observed texting while driving turned out to be driving while intoxicated.

Monday, State Police from Westchester arrested 30-year-old Oscar C. Thomas of East Fishkill for driving while intoxicated, a class D felony. Thomas was charged a felony due to a previous DWI related conviction within the preceding 10 years.

Troopers initially stopped Thomas on the Sprain Brook Parkway for allegedly texting while driving. A subsequent investigation revealed that he was intoxicated at the time of the stop, officials say.

Thomas provided a breath sample that allegedly revealed a Blood Alcohol Content of .08% and was issued traffic tickets directing him to appear in the Town of Greenburgh Court on June 16.
