A Hudson Valley man was indicted for vehicular manslaughter and drug charges, following an investigation.

On April 3, 2016 a two car fatal accident occurred in Marbletown, NY. An extensive investigation was conducted by the New York State Police BCI at Kingston, the Troop F Collision Reconstruction Unit, and the Ulster County District Attorney's Office.

The investigation resulted in a Grand Jury indictment of  Shannon J. Penny, 40, of Accord, NY for vehicular manslaughter and vehicular assault, both felonies, criminal possession of a controlled substance, and unlawful possession of marijuana.

The investigation determined that Penny was traveling in the northbound lane on Rt. 209 in Marbletown when he drove into the southbound lane and struck a vehicle head on. The occupants of the vehicle were Frank Warren, 81 and his wife Leanne Warren, 78. Leanne Warren succumbed to her injuries from the collision at Kingston Hospital. Frank Warren suffered serious physical injuries which he is still recovering from, according to a press release.

Toxicology results from Penny revealed that at the time of the collision he was under the influence of marijuana and prescription medication.

Penny was arraigned and released pending a bail hearing scheduled for October 13th.
