A Staten Island grand jury has cleared a NYPD officer in the choke hold death of Eric Garner, during his arrest for selling loose cigarettes. 

The grand jury voted "no-bill" and dismissed any of the potential charges against Officer Daniel Pantaleo.

The jury was empaneled in September specifically review the evidence Garner's death.

 

Officer Pantaleo said in a statement:

“I became a police officer to help people and to protect those who can’t protect themselves.”

“My family and I include him and his family in our prayers and I hope that they will accept my personal condolences for their loss.”

A lawyer for Garner’s family, Jonathan Moore, told the Associated Press he was “astonished by the decision.”

Garner's family has plans to sue the city for $75 million, on grounds that include: wrongful death, civil rights' violations, and pre-death pain and suffering.
