A West Point cadet has returned to the academy after his rape conviction was overturned.

In May 2017, Cadet Jacob Whisenhunt of Nebraska was dismissed from the U.S. Army and sentenced to 21 years prison after he was found guilty of raping a female cadet as she slept in a sleeping bag during training in July of 2016.

During the trial, the woman said she woke up to Whisenhunt sexually assaulting her and froze in the fetal position. Whisenhunt said the sex was consensual.

Recently, three military judges overturned Whisenhunt's rape conviction, saying there was a lack of evidence to prove the sex wasn't consensual, the Associated Press reports.

The appeals panel stated there wasn't evidence Whisenhunt threatened the woman and the woman didn't make any noise to alert nearby cadets.

On Wednesday, a U.S. Military Academy spokesman confirmed to the Associated Press, Whisenhunt is back at West Point and is in processing.
