A ruling was made after an officer fatally hit a motorcyclist while responding to a call in Dutchess County.

On Friday, New York Attorney General Eric Schneiderman’s Special Investigations and Prosecutions Unit released a report on its investigation into the death of Warren Corbitt near Millbrook in October 2016.

On October 14, 2016, State Police received a report that a person was wielding a knife at a Millbrook High School football game.

One of the responding troopers, Cody J. Vetter, crashed into Corbitt’s motorcycle along the double yellow line in the middle of the road as the trooper attempted to pass the motorcyclist.

Evidence showed that Vetter's lights and sirens were turned on and that another driver pulled to the side of the road while Corbitt drove into the middle of the road, rather than the side, officials say.

In light of the evidence, no criminal charges against Vetter were filed.

“Mr. Corbitt’s death was a tragedy, and we extend our deepest condolences to his family,” Attorney General Eric Schneiderman said in a press release. “We undertook a comprehensive investigation into the incident, and remain committed to ensuring exhaustive and transparent accounting of all cases we investigate.”

The investigation included witnesses and other troopers accounts, as well as an accident reconstruction report that showed the trooper’s vehicle decreasing speed while activating the brake and steering to avoid Corbitt.

A separate ruling by a DMV Administrative Law Judge found that the trooper committed no driving violations that caused or contributed to the accident.
