Damage Control, Inc.: Metallica Rescind Lawsuit Threat Against Tribute Band, Send Their Lawyer Ice Fishing

The members of a Canadian Metallica tribute band can breathe a little easier now that they know they aren't really being threatened with a lawsuit.

As previously reported, lawyers for Metallica recently served the Ontario-based tribute act Sandman with a cease-and-desist letter alleging that their promotional materials infringed on Metallica's "official, stylized logos" — but just as quickly as it arrived, that letter has been rescinded, with the members of Metallica chalking it up to an overzealous (and potentially former) member of their legal team.

"We have a long history of not only enjoying tribute bands, but we started as one. Heck, we even recorded a two-disc album of covers! We will always remember those days and continue to enjoy tribute bands, even inviting them to support us on various tours over the years," Metallica told Rolling Stone. "Sandman should file the letter in the trash. Keep doing what you’re doing ... we totally support you! And in the meantime, our attorney can be found at SFO catching a flight to go permanently ice fishing in Alaska."

According to the statement Metallica issued to Rolling Stone, the band didn't even know about the Sandman letter until it was posted online — and drummer Lars Ulrich was so intent on defusing the situation that he placed a personal phone call to Sandman guitarist Joe Di Taranto.

"He gave me and the band his full blessing to continue on as we were," said Di Taranto. "They want us to continue paying tribute to Metallica with their full blessing and approval. We will continue to fly the Metallica flag, loud and proud!"
