Some people just want their soup. But is it important enough to sue over?

Benji Arslanovksi, owner of Our Place Restaurant in Mansfield, Texas, has spent many years in the food service business. but even he is shocked at this story.

Arslanovksi said a customer came to his restaurant and ordered the Saturday special. The special includes an entree, two sides and a bowl soup. Arslanovksi said that the soup special at the establishment is seen as a "freebie," kind of like a pickle.

According to the owner, it even distinctively says on Our Place's menu that the soup is only included "while supplies last."

Tell that to attorney Dwain Downing. Yes, Downing is not only an attorney, but he was also the customer that day.

"He was upset we wouldn't substitute some veggies or a side item for his soup," Arslanovksi said.

WFFA News 8 says that on Thursday, Downing sent a demand latter to the restaurant saying he wanted $2.25 in damages and $250 in attorney's fees, or that Our Place would be sued. Downing claims the menu is an offer of a contract, and that the restaurant uses a deceptive trade practice.

The attorney went on to say he thinks the restaurant should prepare for running out of soup if it happens regularly.

"I really don't know what to think," said Arslanovksi. "I mean, it's a cup of soup."
