NY State law allows the sale of sparklers starting on June 1, but only if your county has opted in.

Syracuse.com reports that a vote is scheduled for Albany county that would add them to the growing list of areas where sparkler sales are now legal twice a year; 30 days before the Fourth of July and 10 days before New Year's Eve.

Firework legislation has already passed in the Hudson Valley counties of Sullivan, Dutchess, Orange, Ulster, Green and Putnam. That means licensed stores will be able to sell sparklers and other small fireworks to local residents starting on Monday.

Counties that now allow the sale of small fireworks and sparklers are:

  • Chemung
  • Orange
  • Saratoga
  • Washington
  • Montgomery
  • Cattaragus
  • Putnam
  • Herkimer
  • Fulton
  • Yates
  • Dutchess
  • Schuyler
  • Warren
  • Madison
  • Rensselaer
  • Ulster
  • Allegany
  • Niagara
  • St. Lawerence
  • Lewis
  • Franklin
  • Schenectady
  • Steuben
  • Wayne
  • Greene
  • Sullivan
  • Livingston
  • Clinton

Albany County will not be voting on the sparkler ban until June 8th, so residents will have to go elsewhere to purchase them, or hope that the law is passed in time for the 4th of July holiday this summer.
