Kiss Sued by Security Guard Claiming Confetti Injury

If you wanted the best, but instead you were injured after slipping on some wet confetti, you’d probably be pretty annoyed.

That definitely seems to be the case with Timothy Funk, an Indiana man who’s filed a lawsuit seeking damages for injuries he claims he sustained while working security at the Kiss concert in Noblesville’s Klipsch Music Center on Sept. 1, 2012. Funk, who’s suing for “injuries, loss of wages and other unspecified damages,” alleges that it all happened during the band’s big show-closing number, which traditionally culminates with heaps of confetti fired into the crowd.

Scraps of paper floating down from the ceiling may seem harmless enough to most of us, but according to Funk, “some or all of the defendants” also used hoses to spray water “on the stage, the area around the stage and on some of the crowd,” thus creating a “slippery, waxy and glassy” surface in a “foolish and reckless manner.” The exact nature of Funk’s injuries isn’t specified in current reports.

The lawsuit, filed in the Superior Court of Hamilton County, Ind., names the tour promoter, Live Nation, as well as Kiss co-founder Gene Simmons and his associated company. The band has yet to comment on Funk’s allegations.
