On the April 10th edition of “Judge” Jonna, we had a concerned parent with a great kid who wanted to host a small, after-prom party for a few friends. Our litigant wanted to know whether getting the permission of the other children’s parents would absolve her of any liability in the event the kids snuck alcohol into her house.While I understand that “kids will be kids”, it is AGAINST THE LAW, even under the most careful of circumstances, to allow (or to turn a blind eye) to kids who want to booze it up inside your house. So not only would our litigant be liable, but any parent that “consented” to break the law would be liable too!My ruling, therefore, was to put the kibosh on a house party and instead, rent a catering hall or other venue where the kids can dance, hang out and have a good time in an environment where it would be far more difficult to sneak in the hooch (and would keep the parents from any civil or criminal liability in the event Susie Cream Cheese and her friends broke the booze rules ).For more information on “social host liability” I’m including a letter from the Dutchess County District Attorney himself right here.
Judge Jonna is not an actual “Judge” – she is, however, a very real attorney and TV legal analyst, and -- in her own mind - a staunch arbiter of truth, justice, dating problems, loud neighbors, bosses who suck, people who get caught doing stupid stuff, rude drivers, crazy exes, crying babies on planes, trains and at the hairdresser’s, people who meander the grocery store aisles way to slow, and jerks of all shapes and sizes who sometimes rub us the wrong way.
