Could the indoor use of e-cigarettes be banned in the state of New York?

A bill before the state Senate and Assembly would add electronic vaporizers to the list of products covered under the state's Clean Indoor Air Act. The Times Union reports that the bill, which still awaits action in both houses, also appears to be aimed at curbing children's exposure to e-cigarettes at shops that sell them.

According to the Senate bill's memo, it would require e-cig retailers not registered with the Ny State Dept of Taxation and Finance to register with the Dept of Health, thus opening them to compliance checks. Currently, these stores aren't required to have a tobacco registration. E-cigarettes are not regulated by the FDA as of yet.
