The man arrested in connection with the death of a Hudson Valley woman whose body was found in a suitcase is accused of being in the country illegally.

Javier Da Silva Rojas, 24, was in the country on an expired visa after coming to the U.S. from Portugal in 2017, police say. He came to the United States on May 8, 2017, and never left after his visa expired on Aug. 5, 2017, Immigration and Customs Enforcement said in a statement, according to the Washington Post.

Da Silva was arrested in Queens this week and charged with kidnapping resulting in death in the killing of his ex-girlfriend, 24-year-old Valerie Reyes of New Rochelle.

Reyes was reported missing in late January. Days later, she was found dead inside a suitcase in Greenwich, C.T., police say. The woman was found inside the suitcase with her hands and feet bound.
