A Hudson Valley man has filed a class-action lawsuit after a basketball he purchased deflated.

The basketball, made by Russel Brands LLC was advertised as "NEVERFLAT," a claim that the plaintiff, Jaish Markos says is deceptive.

According to Legal News Line, Russel Brands, makers of the Spalding NEVERFLAT basketball, is being accused of making false claims about the ball. Markos claims that the company advertises the ball as guaranteed to stay fully inflated for at least one year. However, according to tests made on the basketballs, he says they lose significant air pressure in less than a year.

The Sultzer Law Group in Poughkeepsie is one of the firms that is representing Markos in the class-action suit, which is seeking monetary damages,punitive damages, court costs and other relief from the company. Amazon currently lists one of the "NEVERFLAT" balls for $39.99.

We're no legal experts, but this sounds like a slam dunk case. Naming a ball that quickly deflates "NEVERFLAT" is basically the same as asking Homer Simpson to leave an all you can eat buffet before he's had "all he could eat."
