A Hudson Valley dentist, who was recently acquitted of murder, is guilty of insurance fraud.

In June, 49-year-old Gilberto Nunez of Poughkeepsie was found not guilty of second-degree murder. The Kingston dentist was accused of killing 44-year-old Thomas Kolman of Saugerties by giving him coffee laced with a dental sedative.

Kolman’s body was found inside his car at a gym parking lot in Ulster County in Nov. 2011.

The Ulster County District Attorney’s Office previously said Nunez’s SUV was seen on video surveillance traveling to and from the scene. Officials alleged Nunez was having an affair with Kolman’s wife, Linda.

In Oct. 2015, the D.A.’s office said Kolman was killed by a sedative called Midazolam, a drug that is only available to dentists and can’t be purchased by the public.

Investigators say they found a search history for the drug on Nunez’s computer.

Nunez’s defense team argued that Nunez had nothing to do with the death. Citing Kolman’s heart condition and sleep apnea as possible factors.

Tuesday in Orange County Court, a jury trial convicted Nunez of seven felonies in connection with insurance scam.

At the trial, prosecutors argued that Nunez stole $8,400 from the Preferred Mutual Insurance Company by filing false documents in support of his claim for payment on an insurance policy for 2014 fire at a building he owned in Kingston.

Nunez claimed that he had lost rental income due to the fire.  Prosecutors argued that building had no paying tenants at the time of the fire.

Nunez is scheduled to be sentenced at a later date.
